Steve Bannon is in violation od Title 50 of the U.S. Code Section 3021, which stipulates who can sit on the NSC. I guess Trump is in violation. Accoring to this Title anyone not fitting those titles applicable to those sitting on the NSC must be approved by the Senate.
Now with the Republican Senate, he might be approved but his hearing would shock the average public who doesn't know who he is.
